This information helps us determine what is most beneficial for our users, and how we can continually create a better overall experience for you.

In some instances we may need more specific information about you, such as name, address, email address, telephone number, etc. We would collect this information if you were to purchase a product via this website.

We do not disclose information about your individual visits to the website, or personal information that you provide, such as your name, address, email address, telephone number, etc., to any outside parties, except when we believe the law requires it.

Sheena’s Place products are subject to GST, unless you are outside Australia

Prices

Sheena’s Place reserves the right to change prices for Products displayed at thesignclub.com at any time.

Payment Methods and Processing

Sheena’s Place currently accepts PayPal, Visa, MasterCard and Direct Deposit.  Mail Orders & cheques may be accepted on a case by case scenario, as decided by Customer Service.

Payment processing cannot begin until we receive all the information we need.

Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding Public holidays.

For credit card and PayPal payments we will email a tax invoice to you with your Order Confirmation. Where you pay by Direct Debit, money order or cheque a tax invoice will be sent to you via email after clearance of your funds has been confirmed. Your tax invoice is your proof of purchase.

Please Note: You may be required to provide further identification for additional security reference checks.

Supply of your Products

Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation. When your Order items have been dispatched, we will email you to confirm shipment of each item.

Delivery of your Products

Delivery time takes up to 10 working days from the date your payment is received, excluding Public holidays. Please note that some payment methods used may delay the shipping process to allow for confirmation on clearance of funds. (Cheques for eg may take over 7 days to clear) Delivery time on Custom Product orders will vary.

Delivery times may change due to changes in supply or circumstances beyond our control. If your Product has not arrived after the estimated delivery time, please contact us by phone or email.

Unless otherwise agreed by us, we will deliver your Products to the address indicated on your Order Confirmation.

If no-one is available to take delivery of your Products by the carrier (Australia Post or other) any ensuing re-delivery arrangement and costs will be a private arrangement between yourself and that carrier.

Title and risk of loss to all Products will pass to you on delivery.

Your Rights to Return a Product

No refunds, credit or replacements are offered if you have changed your mind about the Product, make an incorrect choice, or failed to verify and accurately provide information when placing an Order.

Damaged During Delivery & Insurance

Risk in the goods passes to you when the goods leave our shop.

All claims for damaged or missing goods in transit must be filed with the carrier concerned.

A Product is considered damaged if it shows symptoms of structure failure, or is discovered to be broken when first taken from its packaging. Where the goods are delivered by a carrier other that Australia Post, it is necessary to ensure goods are received in good order prior to signing the delivery docket, as upon signing of this docket you state the goods are in good order.

A Customer Service member will provisionally determine whether the Product is damaged, which may include, but not limited to, photographic evidence. Where a Product is provisionally determined as damaged we will arrange to replace the Product.

Refunds will only be offered where a replacement Product cannot be provided.

Where Sheena’s Place has provisionally determined that a Product is damaged by delivery, any return shipping, if determined necessary, will be arranged at the expense of Sheena’s Place. If the Product is deemed by Customer Service NOT to be damaged during delivery, Sheena’s Place may in its absolute discretion refuse to replace the Product or offer you a refund for the Product.

When a refund is given, the returned Product becomes our property.

If the condition of the Product was misrepresented to us by the customer, Sheena’s Place will impose a $40 handling and administration fee.

Organising the Return of any Product

A Return Authorisation is required for all returning product.  Where Customer Service has provisionally determined that a Product is to be returned, Customer Service will issue you with a Return Authorisation. Products cannot be returned without this Return Authorisation. The Product should be returned to Sheena’s Place within 30 calendar days of the issuance of the Return Authorisation.

All Products must be returned via the agreed method as determined by Customer Service.

Our Liability

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.

Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

Credit Card Fraud

Whilst Sheena’s Place employs the latest in secure technology software for its transactions with our customers, Sheena’s Place will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

General

You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of Sheena’s Place. Any unauthorized assignment shall be deemed null and void.

If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and

Conditions and the remainder of the provisions in question shall not be affected thereby.

Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.

Sheena’s Place reserves the right to change the Terms and Conditions of sale at any time.

No Sheena’s Place employee or agent has the authority to vary any of the Terms and Conditions governing any sale.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia and shall be subject to the non-exclusive jurisdiction of the courts of Australia.
